How long does an eviction take in Colorado?
Most evictions take 2 to 6 weeks from the date the required demand for compliance or Notice to Terminate Tenancy is posted, depending on whether the tenant contests the case. However, Colorado law mandates that the Sheriff cannot remove the tenant during the automatic 10-day stay on execution of the Writ of Restitution.
Can a landlord evict without court?
No. In Colorado, landlords must go through the court process. “Self-help” evictions (such as changing locks or shutting off utilities) are illegal and entitle the tenant to pursue damages against the landlord.
What are valid eviction reasons in Colorado?
Common reasons include non-payment of rent, lease violations, lease expiration, and illegal activity on the property.
What justifies an eviction in Colorado?
A landlord can legally evict a tenant for several reasons, most commonly: non-payment of rent, violations of the lease agreement, staying past the lease expiration date, or engaging in illegal activity on the property.
Can a tenant stop an eviction?
In many cases, yes. An eviction isn't automatic, and tenants have rights. They can often stop the process entirely by catching up on overdue rent or fixing the lease violation before the landlord files in court. If it does go to court, the tenant also has the opportunity to present legal defenses to a judge.
